Paka Planet Terms of Service

1. Agreement to these terms

Effective date: September 25, 2026

These Terms of Service ("Terms") are an agreement between you and Paka Planet LLC ("Paka Planet," "we," "us"). They apply to the Paka: Virtual Companion app, the website at pakaplanet.com, and any other app, tool or service we offer, including Paka Social Poster (together, the "Services").

By using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

2. Who can use the Services

You must be at least 13 years old, or the minimum age required in your country, to use the Services. If you are under 18, you should review these Terms with a parent or guardian.

If a Service asks you to create an account or sign in, you are responsible for keeping your login details safe and for activity under your account. Tell us promptly at pakaplanet@gmail.com if you think someone else has used your account.

3. Using the Services

We give you a personal, limited, non-transferable right to use the Services for their intended purpose. When using them, you agree not to:

  • break any law or anyone else's rights

  • copy, resell, reverse engineer or try to extract the source code of the Services, except where the law allows it

  • interfere with, overload or try to gain unauthorized access to the Services or our systems

  • use bots or scripts to access the Services in ways we have not allowed

  • upload or share anything harmful, abusive, misleading, or that infringes someone else's rights

We may change, pause or stop any part of the Services at any time.

4. Connected accounts and third-party platforms

Some Services connect to platforms run by other companies, such as TikTok, Instagram, X and Google Firebase. When you connect an account, you authorize us to access it only as needed to provide the feature you chose, for example to upload a video to your TikTok inbox as a draft or to publish a post you created.

  • Your use of those platforms is also governed by their own terms and policies, including the TikTok Terms of Service, Instagram Terms of Use and X Terms of Service.

  • You are responsible for the content you post through the Services and for following each platform's rules.

  • You can disconnect an account at any time in the Service or in that platform's settings.

  • We are not responsible for those platforms, their availability, or changes they make that affect the Services.

5. Your content and ours

You keep ownership of anything you create, upload or post through the Services ("Your Content"). You give us permission to store, process and send Your Content only as needed to run the Services for you, such as delivering a post to a platform you connected. You confirm you have the rights to Your Content.

The Services themselves, including the Paka character, artwork, app design, text and logos, belong to Paka Planet LLC and are protected by law. You may not use them without our written permission, except as the Services normally allow.

6. Purchases

If you buy anything in the Paka app, the purchase is handled by the Apple App Store or Google Play and follows their payment, subscription and refund terms. Subscriptions renew until you cancel them in your store account settings.

7. Disclaimers

The Services are provided "as is" and "as available." To the fullest extent the law allows, we make no warranties of any kind, including that the Services will be uninterrupted, error-free or fit for a particular purpose. Paka is a motivational companion, not medical or professional advice.

8. Limitation of liability

To the fullest extent the law allows, Paka Planet LLC will not be liable for any indirect, incidental, special or consequential damages, or for lost data, profits or posts. Our total liability for any claim about the Services is limited to the greater of the amount you paid us in the 12 months before the claim or US $50.

9. Ending use

You may stop using the Services at any time. We may suspend or end your access if you break these Terms or if we stop offering a Service. Sections 5, 7, 8 and 11 continue after your access ends.

10. Changes to these terms

We may update these Terms from time to time. We will change the effective date above and, for significant changes, give notice in the app or on our website. Using the Services after an update means you accept the new Terms.

11. Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Texas, unless the law where you live requires otherwise.
